Fatal Shooting Occurs Near the Georgia Dome

The AJC.com is reporting that 32-year-old Kenneth Davis was shot in the head and killed at a Chevron gas station near the Georgia Dome at the corner of Northside Drive and Markham Street in Atlanta.

According to the police, this homicide was not initially considered to have been a random act, but the investigation is still underway, as the motive has yet to be determined. Also, no description was given of the shooter.

Assisted Living Facilities May be Responsible for Injuring Residents

Recently, PBS Frontline released a three-part series on problems within assisted-living facilities. The PBS series focused on Emeritus, a nationwide corporation with assisted-living facilities in as many as 47 states throughout the United States. Emeritus is a for-profit corporation and the PBS series highlighted some ways in which for-profit assisted-living centers may be putting the lives and health of patients at risk.

Assisted Living Abuses and Injuries

Assisted-living facilities are supposed to provide a less institutional alternative to nursing homes. These facilities allow a senior to get some basic help with life tasks but do not provide intensive or round-the-clock medical care. The idea is that when a resident becomes too ill or the demands of the resident's care exceed what the assisted-living facility can provide, the resident will leave to go to a nursing home.

When the assisted-living facility is for-profit, however, someone leaving to go to a nursing home means that a bed is left unfilled and there is no rent or fees to be collected. As such, employees of assisted-living facilities were being instructed to keep people from going "out the back door." The assisted-living facilities were trying to keep residents living there even when the residents should move on because they couldn't get needed medical help.

Unfortunately, the actions of the assisted-living facility came at a serious cost.  One former pro-football player living in a facility, for example, died after ingesting industrial strength dishwashing chemicals that had not been secured. Another resident with dementia left the assisted-living facility and froze to death. Still another had serious and potentially life-threatening bedsores. The assisted-living facility not only failed to get any medical help for the patient beyond with bedsores having an unqualified employee rub cream into the sores, but the facility actually went so far as to hide the patient's condition from a nurse who was visiting to treat an open ulcer on the patient's foot. The woman who had the bedsores died as a result of the care that she didn't receive and her family took action against the facility and was awarded millions in damages.

When assisted-living facilities fail to provide reasonable care and services to patients and/or put patients' lives at risk to keep beds filled, the facilities must be held accountable. Only when it becomes unprofitable to act this way because of abuse and neglect lawsuits will these care facilities change the way in which they operate.

Man Killed at Apartment Complex Near Norcross, Ga.

WSB is reporting that a man was shot and killed at a Norcross apartment complex, and another man was struck in the head.

The Gwinnett County Police released a statement that the two men, Thomas Smith and Steven Carden, were walking through the Celadon Apartment complex at approximately 7:10 a.m. when Smith was struck over the head and Carden was shot.

The Marietta Daily Journal is reporting that the two men did not live in the complex and that they were confronted by two men right before the shooting occurred.

Other sources are reporting that residents of the community are afraid, and feel that they "need more security around the apartments."

Georgia Apartment Complex Shooting

ROSWELL, Ga. - According to NorthFulton.com, a 20-year-old male was shot in a suburban apartment complex, north of Atlanta, on July 13, 2013.

The shooting took place in the breezeway of one of the buildings at the Orion Apartment complex on Hemingway Lane in Roswell, Ga. The victim took a bullet to the leg and lost a "tremendous amount of blood," said Officer Lisa Holland of the Roswell Police.

The Orion Apartment complex is a pool and tennis community that claims:

"We pledge to provide the finest personal services and facilities to our residents who will always enjoy the highest level of care and personal attention exceeding expectation in every way possible."

Police are still investigating the attack.

Duluth apartment shooting leaves 19-year-old dead

DULUTH, Ga. - The Examiner is reporting that a 19-year-old male identified as Julio Trinidad was shot and killed at The Falls Apartment complex located in the Duluth, Ga. area after midnight on July 18, 2013.

Julio was a resident of the apartment complex and there is speculation that the shooting took place during a robbery attempt. According to the police, he suffered what appeared to be at least one gunshot wound to the head but the extent of the injuries will be determined by the Gwinnett County Medical Examiner.

The Falls Apartment complex is located off of Satellite Blvd. 2 miles from I-85.

Their website states the following:

Tractor-Trailer Accident at Busy Georgia Intersection Causes Injuries and Fatalities

According to My Fox Atlanta, a car accident in mid-July resulted in three deaths and six injuries after several cars were pinned beneath a tractor-trailer.  The accident occurred at approximately 1:00 a.m. on Friday night and involved the tractor-trailer as well as a pick-up truck, a Jeep and a Ford Escape.

Reports from the initial investigation conducted by the police indicated that the crash may have started after the pickup truck made a left turn and collided with the tractor-trailer, which was going in the opposite direction.  The tractor-trailer rolled over in the accident, pinning two cars beneath it.  Our Atlanta truck accident lawyers know that whenever a truck is involved in an accident, rollovers are likely to occur. Unfortunately, these rollovers can be extremely dangerous or even deadly, especially when vehicles are in close proximity at a busy intersection.

Drivers Involved in Tractor-Trailer Crash

The accident took place in Georgia Highway 365 in Gainesville, closing northbound lanes on Highway 364 for almost nine hours.  It allegedly began when the pickup truck driver turned left into the path of the truck.  The tractor-trailer was carrying frozen chicken products.

The driver of the pickup truck that collided with the tractor-trailer was killed. The passenger in his pickup truck was also killed.  Two other vehicles subsequently became involved in the crash, becoming pinned under the tractor trailer when the accident caused it to roll over.

Tractor-trailers, like all trucks, have a high center of gravity. This can make the trucks more likely to roll over, especially when drivers are speeding, going around curves or- as in this case- involved in an accident.  Factors such as a heavy or unbalanced loads can also make a tractor trailer more likely to flip over, although there is no reported evidence at this time indicating that the tractor trailer here was not correctly loaded.

Unfortunately, when trucks and tractor-trailers do roll over, it is not uncommon for cars to be pinned underneath.  These vehicles tend to be very large and when they tip, any other cars in close proximity could become caught underneath. This could do devastating damage to the vehicle and potentially cause serious or fatal injury to all drivers and passengers involved.

In this case, the accident happened at a very busy intersection, which meant that it was even more likely that cars would end up being crushed by the rollover. When vehicles are in close proximity with no place to go, the chances are high that a truck rolling over will endanger them.

For those who were affected by the rollover and who sustained injury, it may be possible to take legal action. In this case, it was the tractor-trailer that caused injury.

However, the underlying crash may have been caused by the pickup driver and the tractor-trailer driver may have done nothing wrong. This means that there are complicated issues of liability regarding who is to blame. Multi-Car Pileup in Georgia Leads to Five DUI Arrests

Early this July, a tragic accident occurred on I-75 in Georgia, when a pedestrian was hit by a car. Unfortunately, this lead to multiple vehicles becoming involved in a pile-up.  Conflicting reports indicate that there were between five and seven vehicles involved, while 11 Alive indicates that there were multiple people injured including at least one critical injury.

Multi-Car Pileup in Georgia Caused by Dangerous Choices

According to 11 Alive, the recent multi-car pileup occurred at approximately 4:30 in the morning on the fifth of July.  A pedestrian was on I-75 and was hit by a motorist. The pedestrian reportedly faces a charge of pedestrian in the roadway.

When the pedestrian was hit, multiple other vehicles also become involved in the accident as well. Multi-car pileups typically happen when other drivers come upon an accident scene and are not able to react in time to avoid becoming involved in the crash themselves. These accidents are more likely to happen when visibility is compromised, such as during bad weather or when it is dark out. If drivers are not paying attention or are impaired, then multi-car pileups are also more likely to occur.

An investigation into the accident has revealed that the pedestrian was not the only one who may have been breaking the law in a way that contributed to this multi-car pileup. Five of the drivers who were involved in the crash have reportedly been charged with driving under the influence (DUI) in relation to the accident.

These drivers may have been consuming alcohol to celebrate the Fourth of July, as this holiday is a popular drinking day each year, resulting in an annual increase in DUI accidents.  If law enforcement is able to prove that these drivers were over-the-legal limit, then the drivers could face jail time and other criminal penalties.

Did Seizures Result in NBA Star Causing Fatal Atlanta Car Wreck?

According to the Bleacher Report, former NBA All-Star Mookie Blaylock surrendered himself to authorities this month. Blaylock has been charged with vehicular homicide after being blamed for a head-on accident. The NBA player reportedly blacked out before the crash, which reports indicate may have potentially been caused by a seizure.

NBA Player Causes Fatal Head-on Crash

The Bleacher Report indicates that the fatal crash involving the NBA star occurred on May 31. Blaylock was driving his Cadillac Escalade when he apparently blacked out behind the wheel. The Escalade went over a median and hit a van head-on. There were two passengers in the van.

One passenger, a 43-year-old-woman, died at the hospital hours after the crash. The other passenger, the husband of the deceased, was rushed to Atlanta Medical Center in critical condition. His condition has slowly improved and it is now looking as though he will make a recovery.

The two innocent victims hit by the Cadillac Escalade suffered unimaginable loss because of the accident. An attorney for the NBA player indicates that Blaylock's blackout may have perhaps occurred because of a seizure. The Jonesboro Police Chief had indicated to a local TV station that Blaylock had a history of seizures and police were investigating whether a seizure may have been the cause.

Blaylock has a long history of driving problems. He is wanted in another state for failure to appear on a DUI charge, and police in this case not only charged him with vehicular manslaughter but also with driving on a suspended license; driving over a median and making an improper lane change. The criminal penalties for the combined offenses, especially for the vehicular manslaughter, mean that the Blaylock may be sentenced to serve prison time if convicted.

Blaylock could also face civil liability, which means that the injured husband could sue to recover for his own injuries and could sue for wrongful death for the loss of his wife. In order for a lawsuit to be successful or for the criminal charges to stick, however, Blaylock must have done something wrong.

Drivers are liable for accidents they cause if they act in an unreasonably careless way,  likely because they did something negligent or dangerous that put others at risk. In this case, civil and criminal authorities will be looking to determine whether his dangerous or careless actions were caused by driving with a seizure disorder and a history of blacking out or driving while under the influence of drugs and/or alcohol.
